
Terms and Conditions - Clients
Please read the following terms and conditions carefully before engaging in personal training services. By participating in personal training sessions, you acknowledge and agree to be bound by these terms and conditions.
Personal Training Services:
1.1. The personal training services provided by Tuned Performance Coaching, ("Maddie"), are designed to assist individuals in achieving their fitness goals through exercise and nutritional guidance.
1.2. The Trainer will provide personalised exercise programs, guidance, and support based on the individual's fitness level, health condition/s, and goals.
Personal Training Sessions:
2.1. Training sessions will be conducted at a location agreed upon by the Trainer and the client, such as a gym, fitness studio, or client's residence.
2.2. The frequency, duration, and scheduling of personal training sessions will be mutually agreed upon between the Trainer and the client.
2.3. The client must arrive promptly and be prepared for each training session, including appropriate attire and any required equipment.
Online Coaching:
3.1. Online coaching requires a minimum commitment of 12 weeks to ensure clients achieve measurable progress and results.
3.2. By signing up for online coaching, clients agree to complete the 12-week period before requesting any cancellations or changes to their coaching plan.
3.5. In-person sessions must be pre-booked and confirmed in accordance with standard booking policies.
3.6. Client will receive access to Tuned Performance Coaching app when committing to online coaching.
3.7 All client payments must be up to date in order to maintain access to Tuned Performance Coaching. app.
3.8. Failure to keep payments up to day may result in restricted access to Tuned Performance App or cancellation of services.
3.9. Online coaching includes customised training program, progress tracking and direct communication with coach for guidance and support.
3.10. Online coaching is non-refundable. Exceptions may apply for extenuating circumstances at the discretion of the coach.
3.10 Cancellations must adhere to the standard 24-hour cancellation policy (4.0).
3.11. Clients are expected to adhere to the program guidelines, provide regular updates on progress, and communicate openly with their coach.
3.12. Failure to engage in the program may limit results and will not warrant a refund or extension of services.
3.13. Changes to the program, including rescheduling sessions or adjusting training plans, must be discussed and agreed upon in advance.
3.14. Additional services outside the scope of the agreed program may incur extra charges.
3.15. The coach reserves the right to terminate services if the client breaches these terms or demonstrates behaviour inconsistent with a professional coaching relationship.
24-Hour Cancellation Policy:
4.1. If the client needs to cancel or reschedule a training session, they must provide a minimum of 24 hours' notice to the Trainer.
4.2. Failure to provide 24 hours' notice will result in the full session fee being charged, unless otherwise agreed upon by the Trainer.
4.3. If the Trainer needs to cancel or reschedule a training session, they will provide a minimum of 24 hours' notice to the client and offer an alternative session time or refund for the canceled session.
Fees and Payments:
5.1. The client agrees to pay the Trainer the agreed-upon fee for each personal training session in a timely manner.
5.2. Payment for each session must be made before or at the beginning of the training session, unless otherwise agreed upon by the Trainer.
5.3. In the event of non-payment or late payment, the Trainer reserves the right to suspend or terminate services until payment is received.
5.4. A late payment fee of $20 will be applied if payment is not received within 24hrs after the personal training session.
5.5. Fees for personal training services provided by Tuned Performance Coaching (“Maddie”), are subject to change and may vary from time to time.
5.6. Any Changes to the pricing structure will be communicated to the client in writing at least 7 days prior to the new prices taking effect. Notifications will be sent via email and/or SMS.
5.7. Any prepaid packages or individual sessions purchased before the effective date of the new pricing will be honoured at the original price until the package or sessions are completed.
5.8. Any prepaid packages must be used within 365 days of purchase. Any remaining sessions after 365 days will be voided.
5.9. Payments for online coaching services must be made on the first day of the week (Monday).
Refund Policy:
6.1. Sessions are non-refundable, unless agreed upon by the trainer.
6.2. Remaining sessions may be transferred onto fellow members, who must complete the onboarding process before completing any sessions.
6.3. Refunds, if applicable, will be provided for the unused portion of packages.
Under 18 Clients:
7.1. In the event the client is under the age of 18, the client will be required to recieve parental consent before proceeding with any services.
7.2. Client will be required to complete an addition “Under 18 Induction” form before proceeding with any services.
Social Media and Marketing:
7.1. By signing this contract, the client gives consent for Tuned Performance Coaching, (“Maddie”), to photograph and/or record video footage of the client during training sessions.
7.2. The client agrees that any photographs, videos, or other media captured during the training sessions may be used by Tuned Performance Coaching, (“Maddie”), for promotional and marketing purposes. This includes, but is not limited to, social media platforms (e.g. Instagram, YouTube, Facebook), website, promotional materials and advertisements.
7.3. Tuned Performance Coaching, (“Maddie”), agrees to use the content in a respectful and professional manner, ensuring the clients dignity and privacy are maintained. Clients will not be used in a way that misrepresents the client or their progress.
7.4. The client has the right to opt out of being filmed or photographed. If the client wishes to opt out, they must notify Tuned Performance Coaching, (“Maddie”), in writing prior to the start of the training session. In such cases, the client will not be included in any content used for social media or marketing.
7.5. The client acknowledges that they will not receive any compensation for the use of their likeness in the promotional and marketing content created by Tuned Performance Coaching, (“Maddie”).
7.6. The client retains all legal rights to their likeness and can request the removal of any content they feel misrepresents them or violates their privacy. Such requests must be made in writing.
Results Disclaimer:
8.1. While Tuned Performance Coaching (“Maddie”), provides guidance to help clients reach their desired fitness goals, results are not guaranteed. Individual results depend on client adherence, commitment, and external factors.
Referral Program:
9.1. Current paying clients of Maddie Hearn Fitness, (“Maddie”), are eligible to participate in the referral program.
9.2. Clients who refer a friend to the trainer will receive one complimentary training session if the referred friend signs up for a personal training package.
9.3. Referring client must provide the trainer with the referred friend’s name and contact information before referred friend’s initial consultation or sign-up.
9.4. Referred friend must mention the referring client’s name at the time of their initial consultation or sign-up.
9.5. Complimentary sessions will be rewarded to both referring and referred clients once the referred friend has signed up and paid for their personal training package.
9.6. Complimentary sessions must be used within 30 days from the date it is awarded. Sessions not used within this period will be forfeited.
9.7. Clients can refer multiple friends. For each friend who signs up for a personal training package, both the referral and referring client will receive a complimentary session.
9.8. Complimentary sessions are non-transferable and have no cash value.
9.9. Trainer reserves the right to modify or terminate the referral program at any time without prior notice. Changes will not affect referrals made prior to the modification or termination.
Liability:
10.1. The client acknowledges that participation in personal training sessions carries inherent risks, including but not limited to physical injury, illness, or death.
10.2. The Trainer is not liable for any loss, injury, illness, or death that may occur during or as a result of participation in personal training sessions, except in cases of wilful misconduct or gross negligence on the part of the Trainer.
10.3. The client agrees to disclose any pre-existing medical conditions, injuries, or limitations that may affect their ability to safely participate in personal training sessions.
10.4. The client assumes full responsibility for their own health, safety, and well-being during personal training sessions and agrees to follow the Trainer's instructions and recommendations.
Amendments:
11.1. Tuned Performance Coaching (“Maddie”), reserves the right to amend these terms and conditions at any time. Clients will be informed of any significant changes before they take effect.
Code of Conduct:
12.1. Clients are expected to;
12.2. Arrive on time and be prepared for each session.
12.3. Wear appropriate attire.
12.4. Show respect for the trainer and other members within facility.
Confidentiality:
13.1. The Trainer agrees to keep all client information, including personal and health-related details, confidential unless required by law to disclose such information.
Termination of Services:
14.1. Either the Trainer or the client may terminate personal training services at any time by providing written notice to the other party.
14.2. In the event of termination, the client remains responsible for any outstanding fees or sessions for services rendered up to the date of termination. By engaging in personal training services, you confirm that you have read, understood, and agree to abide by the terms and conditions outlined above.
